Terms & Conditions
These terms and conditions ("Terms") govern the purchase of products ("Products") from www.thewhatsupp.com (the "Website"). Please read them before ordering. By placing an order you agree to these Terms. Your use of the Website itself is governed by our Website Terms of Use, and our handling of your personal data by our Privacy Policy.
Nothing in these Terms affects your statutory rights as a consumer.
1. Who we are
The Website is operated by The Whatsupp Co. Ltd, trading as The What Supp Co. ("we", "us"). We are registered in England and Wales, company number 15584210. Our registered office is PO Box 80568, London NW6 9AR.
You can contact us at hello@thewhatsupp.com.
2. Our Products
Our Products are food supplements in wearable patch form. They are not medicines and are not intended to diagnose, treat, cure or prevent any disease. Food supplements should not be used as a substitute for a varied, balanced diet and healthy lifestyle.
Our Products are not suitable for children under 16. If you are pregnant, breastfeeding, taking medication or under medical supervision, please check the ingredients and consult a health professional before use. Stop use and seek advice if you experience any adverse reaction.
3. How your contract with us is formed
- Select your Products and follow the checkout prompts. You can review and amend your order up to the point you confirm payment.
- Once your order is submitted, we will email you an acknowledgment with your order number and a summary of your order. This confirms we have received your order - it is not yet acceptance of it.
- A binding contract between us forms when we email you to confirm your Products have been dispatched ("Dispatch Confirmation"). If Products from one order are dispatched at different times, a separate contract forms for each Product on its dispatch.
- We may decline an order - for example where a Product is out of stock or discontinued, where we cannot authorise your payment, or where we identify a pricing error (see section 6).
4. Delivery
- Delivery options and current charges are shown at checkout and on our Shipping page. As a guide:
UK Standard (tracked): 2-4 business days - £3
UK Express (tracked): 1-2 business days - £5.50 (orders placed after 1pm GMT dispatch the next business day)
Europe (international tracked): 5-8 business days - €6
US (international tracked): 5-10 business days - $10 - We will deliver to the address you give at checkout. Please check it carefully - we cannot change the delivery address after an order is placed.
- If we are unable to deliver your order within 30 days of placing it, you may cancel and receive a full refund.
- For orders delivered outside the UK, customs charges and import duties may apply. These are your responsibility - we are unable to cover or control these fees, and they are not included in our prices.
- Delivery timescales are estimates and may occasionally be affected by events outside our control (for example courier disruption or extreme weather). If there is a delay we will keep you informed. This does not affect your right to cancel under 4.3.
5. Risk and ownership
Responsibility for the Products passes to you on delivery. Ownership passes to you on the later of full payment and delivery. We remain responsible where Products arrive damaged or defective (see section 8).
6. Price and payment
- Prices are as shown on the Website at the time of your order. They include UK VAT and exclude delivery, which is added at checkout.
- Payment is taken in full at the time of order, by major credit or debit card. By paying, you confirm the card is yours. All payments are subject to verification and authorisation by your card issuer; if authorisation fails, we are not obliged to accept your order.
- Prices may change at any time, but changes will not affect orders for which you have already received a Dispatch Confirmation.
- If we discover an obvious pricing error affecting your order, we will contact you so you can choose to proceed at the correct price or cancel with a full refund.
7. Cancellation and returns
Your legal right to cancel. As a consumer buying online, you have the right to cancel your order within 14 days of receiving it, without giving a reason. Because our Products are sealed goods that are not suitable for return once unsealed (for health and hygiene reasons), this right applies to unopened packs with the hygiene seal intact.
Our 30-day returns policy. We go further than the legal minimum: you may return any Product within 30 days of delivery, provided it is unused, unopened and in its original packaging. To start a return, email hello@thewhatsupp.com with your order number.
Refunds are made to your original payment method within 14 days of us receiving the returned Product (or evidence that you have sent it back). Where you cancel a whole order within the 14-day cooling-off period, we will also refund standard delivery charges.
Return postage for change-of-mind returns is paid by you. Where a Product is faulty or was sent in error, return postage is on us.
Changes before dispatch. Our warehouse processes orders quickly, so we cannot guarantee changes or cancellation once an order has been placed. If dispatch cannot be stopped, your cancellation and returns rights above still apply.
8. Faulty, damaged or incorrect items
If anything arrives damaged, defective or not what you ordered, please email hello@thewhatsupp.com with your order number (a photo helps). We will replace or fully refund, including delivery costs, in line with your rights under the Consumer Rights Act 2015. Nothing in these Terms limits those rights.
9. The Feel-the-Difference Guarantee
Trying something new is a leap of faith - so we take the risk, not you.
- The Guarantee is available to first-time customers on their first pack only, with one claim per customer/household.
- Wear your first pack. If you don't feel the difference, email hello@thewhatsupp.com within 60 days of delivery - even if you have opened the pack and worn every last patch.
- We will refund the price you paid for the pack (excluding delivery charges), to your original payment method.
- The Guarantee is available on UK orders.
- The Guarantee is in addition to, and does not affect, your statutory rights and our 30-day returns policy.
10. Subscriptions ("Subscribe & Save")
- When you subscribe, you authorise us to charge your saved payment method at your chosen frequency until you cancel. Your first subscription order is charged at sign-up; subsequent orders are charged automatically on each renewal date.
- We will email you a reminder before each renewal (typically 3-5 days in advance), including the price and date of the upcoming charge.
- You can cancel at any time, free of charge, in your account or by emailing hello@thewhatsupp.com. Please cancel at least 24 hours before your next renewal to avoid that charge. You will receive a cancellation confirmation email and will not be charged again.
- You can also pause, delay or change the frequency of your subscription in your account.
- If a renewal payment fails, we will attempt to process it again. After multiple failed attempts, your subscription may be paused.
- We may change subscription pricing. We will give you notice by email before any price change takes effect, and you can cancel before it applies. If a subscribed Product becomes unavailable, we will notify you and offer alternatives or the option to cancel.
- Delivery, returns, the cooling-off right and your statutory rights apply to each subscription order just as they do to one-off orders. Returning or receiving a refund on one subscription order does not cancel your subscription - please cancel separately as set out in 10.3.
11. Promotions and discount codes
Unless otherwise stated: one discount code per order; codes have no cash value; codes may exclude subscriptions; and codes may be withdrawn at any time. Any additional conditions will be stated with the promotion.
12. Our liability to you
- We are responsible for foreseeable loss or damage caused by our breach of these Terms or our failure to use reasonable care and skill. We are not responsible for losses that are unforeseeable, or for business losses - the Website is intended for consumers.
- Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded by law - including your rights under the Consumer Rights Act 2015.
13. General
- Events outside our control. We are not liable for delay or failure to perform caused by events beyond our reasonable control, although your right to cancel undelivered orders (see 4.3) is unaffected.
- Transferring rights. We may transfer our rights and obligations under these Terms to another organisation; your rights under these Terms will not be affected. You may not transfer yours without our agreement.
- If part of these Terms is invalid. If any part of these Terms is found to be unlawful or unenforceable, the remaining parts continue in full force.
- Complaints. We would much rather fix it than argue about it - email hello@thewhatsupp.com and we will do our best to resolve any problem quickly.
- Governing law. These Terms are governed by the law of England and Wales. Disputes may be brought in the courts of England and Wales (or your local courts if you live in Scotland or Northern Ireland).
